Divorce and Child Welfare
If you have children under the age of 18, before granting a divorce the Court needs to be satisfied that you have an agreement in place for your children’s welfare, covering matters such as schooling, parenting arrangements, child support and medical issues. This can be an informal agreement, but due consideration needs to be made as part of the divorce process.
Applying for Divorce – What You Will Need
It’s important to know what you will need when applying for a divorce. You will need:
- A photocopy of your marriage certificate;
- To have been separated for at least 12 months and one day (you are not required to provide evidence at the time of the application, however if there is a dispute about the separation date you may be required to provide evidence at a later stage);
- Your marriage to have broken down, with no reasonable likelihood that you will get back together; and
- To be an Australian resident or citizen or regard Australia as your permanent home.
If you can satisfy all of the above and you make a joint application with your spouse (whether or not there are children under the age of 18), you do not have to attend court to obtain your divorce.
