Experienced Adelaide Divorce Lawyers – Someone to Trust
At Adelaide Legal we understand that divorce can be a difficult, emotionally draining experience and that’s why you need someone that you can trust to progress your divorce and property settlement, starting from the initial contact with your ex-partner through all the stages to resolution.
Our experienced divorce lawyers are here to guide you and work with you to achieve the best possible outcome.
We can help you work through the many issues you encounter when faced with the prospect of divorce, such as resolving property issues and ensuring that the children are cared for with minimum disruption to their routine.
You can finalise your property matters prior to your divorce and indeed, many clients choose to do so. Once a divorce has been finalised, there is a 12 month time limit within which your property settlement must be completed, otherwise you may lose your right to bring a claim if the matter cannot be resolved without litigation. You can apply for property settlement at any point after separation.
Do You Need to go to Court to Get Divorced?
Court action isn’t always inevitable and we can often assist with your divorce matters without any court involvement at all, saving you time, money and taking some of the stress out of the process for you. We’re here to help.
To apply for a divorce you need to have been separated for at least 12 months, but you can meet with a lawyer to find out where you stand at any time, to familiarise yourself with your rights and your options.
Adelaide Legal Sensible Divorce Lawyers – Free 30 Minute Consultation
At Adelaide Legal we pride ourselves on positive feedback and client satisfaction. We work with you and for you at this difficult time and we aim to do this at a sensible price. We offer an initial free 30 minute, no obligation meeting, where you can meet with one of our experienced lawyers and discuss your situation and options. That way, you know exactly who you’re dealing with and can feel comfortable and confident that we will deliver the service you expect and deserve.
Divorce is the legal ending of your marriage and we understand that this can be an emotional step to undertake. But you also need to know that divorce does not finalise your financial property matters and nor does it resolve the issues of child care and shared parenting.
Divorce and Child Welfare
If you have children under the age of 18, before granting a divorce the Court needs to be satisfied that you have an agreement in place for your children’s welfare, covering matters such as schooling, parenting arrangements, child support and medical issues. This can be an informal agreement, but due consideration needs to be made as part of the divorce process.
Applying for Divorce – What You Will Need
It’s important to know what you will need when applying for a divorce. You will need:
- A photocopy of your marriage certificate;
- To have been separated for at least 12 months and one day (you are not required to provide evidence at the time of the application, however if there is a dispute about the separation date you may be required to provide evidence at a later stage);
- Your marriage to have broken down, with no reasonable likelihood that you will get back together; and
- To be an Australian resident or citizen or regard Australia as your permanent home.
If you can satisfy all of the above and you make a joint application with your spouse (whether or not there are children under the age of 18), you do not have to attend court to obtain your divorce.
